  1. General

    1. This Website with the URL of https://ivynestapartments.com/ (the “Website /Site /Mobile App”) is owned and operated by Ivy Nest Apartments.
    2. By visiting our website and accessing the information, services, and products we provide, you understand and agree to accept and adhere to the terms and conditions as stated in the Terms and Conditions (please refer to the Terms and Conditions Policy link of this Website for more information).
    3. We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.
  2. Cancellation of the Subscription of a Product/ Service

    1. The subscription of service or product or any one-time payment while consuming the service shall be governed by the Terms of Use, Privacy Policy and this Cancellation & Refund Policy.
    2. The Ivy Nest immediately informs the concerned vendor or partner about your appointment and arrangements are done accordingly by the team. Since, the expenses are incurred on such arrangements and bookings, therefore Ivy Nest follow partial refund policy which is subjected to the time and other conditions.
  3. Vacation of Property, Apartment or Premises

    1.  Property/apartment/premises has 6 (six) month lock-in from the date of Occupancy.
    2. Security is refundable only after completing 6(six) months stay with a 1(one) month prior vacation notice.
    3. No security money will be claimed under any circumstances if the lock-in period is not completed.
    4. No security money will be claimed if not given (one) month prior notice.
    5. No unofficial or informal notice of vacation will be accepted, apart from formal written notice mentioning the date of vacation of property/apartment/premises, reason and added with N.O.C clearance of belonging taken and nothing left over.
    6. Notice of vacation is to be given by the Licensee with 1(one) month prior notice. If any dispute is found or any payment issue or inappropriate behaviour and/or attitude towards the Licensor by the Licensee is found or noticed, in such case the Licensor’s terms and conditions applicable to standard cases as available on the Licensor's online portal shall apply and the Licensee shall be strictly bound by the same.
    7. In extreme case, the property/apartment/premises can be vacated in a day under the Licensor’s specific guideline and legal guideline and with legal help and process.
    8. A Licensee is mandatorily required to raise the request to vacate through the Licensor’s App with a minimum of 30(thirty) days prior to the date of vacation irrespective of duration of stay.
    9. Any request to cancel/withdraw the request for vacation of property/apartment/premises already made earlier needs to be given via mail at operations@ivynestapartments.com within 7(seven) days from the date the notice of vacation was given. For example, if the Licensee has given the notice to vacate the property/apartment/premises on 01/12/2021 than the Licensee must inform the Licensor/operation within and latest by 08/12/2021 about the cancellation/ withdrawal of the request for vacation of the property/apartment/premises.
    10. Any request to extend the stay has to be made minimum of 10(ten) days prior to the date of vacation of the property/apartment/premises through the Licensor’s App, which will be considered subject to availability.
    11. Post Vacation initiation date, rent is payable for the next 30(thirty) days mandatorily even if the Licensee wants to vacant earlier than thirty days. Rent is to be paid via the Licensor’s App or Payment link shared on the Licensee registered Phone No. or Mail ID.
    12. The payment / refund policies for the notice period varies based on the vacation date and is illustrated below:
      1. Condition 1: -
        If the Vacant Notice is initiated on the 1st to 31st of the same month and vacated on the same month, the Security money will be forfeited.
      2. Condition 2: -
        If the vacant notice is initiated on 1st or 31st and vacated next month between 1st to 5th, rent of each day shall be paid via subscription or shall be deducted from the given security money. hence the rest amount will be returned after the deduction mentioned above on the 6th of next month.
      3. Condition 3: -
        If the vacant notice is initiated between 1st to 30th, and vacated next month between 1st or 30th, if the rent is not paid then the Security Money will be forfeited.
      4. Condition 4: -
        If vacated without notice the rent will continue to accrue, till one month (1) Prior Notice initiated.
  4. Extension of Date of Vacation

    1. For the extension of date of vacation, the Licensee has to apply for the extension in the Notice to Vacate, the request which must be submitted to the Licensor’s App.
      1. The request must be submitted minimum of 10(ten) days prior to the date of vacation of the property/apartment/premises.
      2. Extension request is subject to availability of accommodation and will be approved only when the Licensee pays extra accommodation charges in advance.
    2. If approved, the rent for additional days has to be paid through the payment link shared with the Licensee on its registered Phone No. & Mail ID.
    3. Notice Period extension request in the last 10(ten) days prior to the date of vacation of the property/apartment/premises will    result in creation of a new booking and all charges applicable for a new booking shall apply
  5. Refund

    1. The return policy Of the Licensor is based on a 7(seven) day plan. The Licensee can claim refund within 7(seven) working days of doing the booking provided there is a valid reason for cancellation.

    2.  Refund and return policy are not applicable for discounted price plans.

    3. The refunds shall be made only after deducting the applicable taxes and platform fee of Ivy Nest that varies as per service to service.

    4. In case the Licensee would like to get refund on property booking, please note the following:

      1. Refund will only be allowed/possible within 7(seven) days of booking.

      2. Standard deduction same as given in the system shall be applicable.

      3. Items used or having indications of usage will not be returnable or accepted.

  6. E-NACH Cancellation

    1. The Licensee and the Licensor confirms/ acknowledges that all subscription fees are charged automatically on a recurring basic until the Licensee cancels their channel subscription (Both Month to Month and Annual plans)

    2. The Licensee may cancel their subscription by logging into the Licensor’s ERP software Link. A confirmation Mail receipt is sent to the Licensee with expiration date of the subscription.

    3. The Licensee shall keep in mind that the Licensee is/are solely responsible for properly cancelling its account. The Licensee must mail its request to “support (info@ivynestapartments.com)” before or on the payments due date. However, you can also contact support (accounts@ivynestapartments.com) if you are having difficulty or need any help.

    4. For monthly dues being paid within a channel you must contact the administrator of the channel to have you removed from the channel, cancel your account or unsubscribe from the channel.

  7. Account Details

    1. Refund will only be done via online net banking and no other mode of refund will be permitted.

    2. Refund will be only be made to the account from which the Licensor has received the money

  8. Cancellation Process

    1. To cancel the subscription of a product or service, please email customer service at accounts@ivynestapartments.com or make a cancellation request at the Ivy Nest Mobile App, to obtain a Cancellation Request Number.
    2. The cancellation of the Product/Service shall depend upon the individual item or service, type of service etc., for which the details will be available on the Mobile App.
    3. Upon receiving the return request, we shall verify the request and if found genuine, we will arrange a cancellation of the product/service.
  9. Exceptions

    1. Ivy Nest hereby points out the following exceptions to this Refund & Cancellation Policy.

        1. The refunds shall not be processed and summarily rejected if you make a request for cancellation before less than 6 hours of starting of the service.
        2. Ivy Nest shall not process the refunds if the booking is done for a wrong person or place.
        3. Ivy Nest and you, both shall be bound by the terms and condition of the respective partner or vendor. Therefore, if you flout any of the conditions specifically mentioned by the partners or vendors, then the refunds shall not be processed.
        4. At certain places, you may need to show the ID Cards to verify your identity. If you fail to prove your identity, then you be stopped at the entry gate only and in such cases, the refunds shall not be processed.
  10. Response Time

    1. A refund is normally processed within 7 Business days after the completion of formal procedure at the end of Ivy Nest.

    2. Refunds may take 1-2 billing cycles to appear on your credit card statement, depending on your credit card company. We will notify you by email when your return has been processed.

    3. If you have made the payment through UPI or Bank transfer then the refund shall be deposited in your bank account by Ivy Nest within 7 working days.

    4. The period of refund may also depend on various banking and payment channels, and we will not be liable for any errors or delay in a refund due to banks or third-party service providers.

       

  11. Refusal of a Cancellation or Refund Request

    1. ​​​​​​​We reserve the right to refuse or cancel any return request if such a request is not in compliance with this Policy or Applicable laws.
    2. It is hereby agreed by you that the cancellation of an order or subscription shall be processed as per the decision of the Ivy Nest only. Ivy Nest shall have all the rights to reject the cancellation request made by you.
