KNOW YOUR RIGHTS, RIGHTS OF TENANT

Starting new at any place leaves us vulnerable to being taken advantage of due to our lack of experience. This holds true especially in cases where you rent a house in a new place. Being given unfair terms and rules to follow and lack of information makes it so much harder than it needs to be.

In cases like these, knowing your rights and understanding the basic right and wrong goes a long way. So, to begin with the very first right that is

1. RIGHT TO REFUSE FORCEFUL EVICTION: Despite the comfort that these rental apartments provide, there is always a concern of receiving an unjust eviction notice from the landlord that distresses the tenant. Pertinent to it, the state government has made certain grounds of eviction and any reason not complying with those grounds would be considered invalid. Landlords don’t have the liberty to evict their tenants merely on grounds of unfriendly or unorganized behavior. There has to be a substantial and concrete reason behind the notice of eviction. The landlord cannot compel the tenant to vacate the apartment if he is timely fulfilling the rental obligation mentioned in the mutually signed contract. The tenant has the right to refuse eviction if he has complied with the terms of the contract and has not indulged in any wrongful act.

 2. RIGHT TO FAIR RENT: When we talk about rent or broadly when we talk about money, we know that it plays a pivotal role in shaping the economic arena of human beings. So charging unreasonable and exorbitant rent puts an unjust financial strain on the income of people, damaging their livelihood. So this particular provision protects tenants from such exploitation and ensures that they are not overcharged for the amenities they are receiving. What determines fair rent? It is basically 8-10% of the market value of the property which is considered the benchmark for the maximum rent that could be charged on the tenant, notwithstanding the 10% automatic increase in the rate of rent after the expiry of the first lease agreement.

3. RIGHT TO ACCESS ESSENTIAL SERVICES: The landlord has no right to deprive its tenant of essential amenities like electricity, water for retrieving rental dues or for any reason whatsoever.

 4. EXTENSION OF TENANCY; The landlord has no right to extend the tenancy on his own yearning. He can’t compel the tenant to extend the tenure of its stay if he doesn’t want to. The tenant has the right to leave the premises anytime for valid reasons.

5. RIGHT TO SAY NO TO AN ORAL AGREEMENT: If your landlord forces you to have a verbal agreement instead of a written one, you have all rights to say no because in case of a dispute, you’ll not be left with anything to prove your stand in the case because mere words don’t hold legal significance.

You could be anyone but not knowing your rights will render you helpless at times. So remember that knowledge indeed is power.
