Work From Home Policy

This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.  By clicking on the “I ACCEPT” button on this electronic contract, you/user are consenting to be bound by this Agreement. Please ensure that you read and understand all the provisions of this document before you start using the IVY NEST, as you shall be bound by all the terms and conditions herein upon clicking on the “ACCEPT & CONTINUE” button on this electronic contract. If you do not agree or accept any of the Terms and Conditions contained herein, then please do not use the IVY NEST’s digital platform or avail any of the services being provided therein.

The Work from Home Policy of Ivy Nest Apartments is as under.

1. Interpretation

  • In this Agreement: words importing the singular include the plural and vice versa; words denoting the masculine gender shall include the feminine gender and neuter gender; a person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality); unless stated otherwise the words "include" and "including" shall be construed without limitation; all reference to statutes shall include any modification, re-enactment or extension thereof for the time being in force; a reference to a clause, annex, annexure, appendix or schedule is a reference to a clause of or an annex, annexure, appendix or schedule to this Agreement. Schedules shall form part of this Agreement and shall have effect as if set out in full in the body of this Agreement. the headings and bold typeface are only for convenience and shall be ignored for the purpose of interpretation of this Agreement; a disclosure of an item in writing referring to a specific Clause of this Agreement or specific Clauses of any Schedules and/or Annexure shall be deemed to be a disclosure only for the purposes of that clause and not for the purposes of any other provision of this Agreement; and where a word or phrase is defined, other parts of speech and grammatical forms of that word or phrase shall have the corresponding meanings.

2. Scope of the Policy

  • This policy applies to all Current/Regular, Permanent and Prospective employees of the Ivy Nest Apartments and its wholly owned subsidiaries, who are working remotely or opted for the Work from Home scheme of the Company.

3. Policy Statement

  • In response to the Flexible Work Practices, the Company is making allowances for the employees of the Ivy Nest Apartments to Work from Home. The Work from Home scheme is in place to assist in achieving a work life balance as part of Ivy Nest Apartments Working Policy. If a majority of your job duties can be performed from home with minimal direction/supervision, you may be able to work remotely. All requests to work remotely must be made through HR department. 
  • As with other forms of flexible working, there is no automatic right to Home Working. The benefits of Home Working can include: -  
    • Employee retention,  
    • Increased productivity and  
    • Reduced costs of accommodation and other overheads.
  • Not all work is suited to this sort of scheme, so availability will be based on suitability of the employment and person to Home Working, demonstrable benefits and measurable outcomes for the service, the post involved, the needs of the service, and the proposed workplace. The needs of the service will always be the paramount consideration.
  • The success of the work from Home will depend on trust, reasonableness and cooperation between managers and employees. Home Working is to be treated in exactly the same way as if the employee was working in the office. Homeworkers will be treated no less favourably than any other member of staff with regard to Company policies and procedures or terms and conditions.
  • Home Working/Work from Home is, therefore, the name given to the practice whereby employees formally undertake work from home or another suitable location, whether it is on an occasional or longer-term basis. Employees may use a computer and telephone line to carry out part, or all, of their job.

4. Eligibility and WFH Arrangements

  • The Company recognises that there may be occasions where it may be appropriate or necessary for employees to carry out certain types of work from their own home on an occasional or ad hoc basis. Computer work will be a frequent example of this.
  • Subject to prior authorization employees must have Home Internet Connection, Personal internet connection is the employee’s responsibility and will not be reimbursed by the Company. 
  • Employees working from home should take personal responsibility for their own health and safety. If an employee feels that working at home is/may be affecting their health, e.g. headaches, and backache, then they must inform their manager, who will then withdraw permission. 
  •  It is the employee’s responsibility to work safely and report any risks to their manager, including reporting any defects that arise in the equipment provided.
  • The employee should have Zoom/Google Meet/Skype connection in his laptop for video conferencing.

5. Enrolment with WFH

  • Before enrolling, the Employee should ensure that they have discussed with and received Reporting Manager approval, and that they meet all eligibility criteria. Once approved, the Employee can go ahead and submit the enrolment application form.
  • If an Employee returns to work exclusively at Ivy Nest’s office, they must un-enrol from the Work from Home scheme; they may be required to return benefits/ equipment received while enrolled in this WFH Scheme.

6. Duties and Obligations of the Employees

  • If an employee is granted permission to work from home, the following conditions apply:
  • The employee will remain accessible and productive during scheduled work hours.
  • The employee will maintain satisfactory performance standards.
  • The employee will communicate regularly with his or her supervisor and may be asked to provide a weekly written report of activities.
  • The employee will remain available for the Conference Calls and the Scheduled Calls as needed.
  • The employee will maintain a safe and secure work environment at all times. The employee will report work-related injuries to his or her manager as soon as practicable.
  • Employees will report to the employer’s work location as necessary upon directive from his or her supervisor.
  • The employee understands that all tools and resources provided by the company shall remain the property of the company at all times. The employee agrees to protect company tools and resources from theft or damage and to report theft or damage to his or her manager immediately.
  • The employee understands that all terms and conditions of employment with the company remain unchanged, except those specifically addressed in this agreement.
  • The employee understands that management retains the right to modify this Policy on a temporary or permanent basis for any reason at any time.
  • The employee agrees to return company equipment, passwords, files and documents within five days of termination of employment.
  • The employee agrees to comply with Company policies and expectations regarding information security. The employee will be expected to ensure the protection of proprietary company and customer information accessible from their home offices

7. Working Hours

  • The Employee must ensure that they are available over the Telephone, Email and other messenger Apps provided by the Company during the assigned Working Hours.
  • The employee has to strictly follow the schedule as prescribed by the Company from time to time. 
    • Employee’s work hours must remain at __ hours, and must be between __ AM to __ PM. 
    • Overtime working hours must be approved by the Reporting Manager.
    • Employees must email the HR each work day to report the time they clocked in and clocked out.
    • Employee must answer office phone and/or personal cell phone during work hours. Phone charges will be reimbursed upon only on management approval.
    • If the position requires hard copies of data to perform duties, the employee will drive to the office to pick up the material.
  • If the department manager or senior management does not believe productivity is being met, the employee will lose the WFH opportunity and return to work.

8. Health and Safety

  • Employees are legally responsible for ensuring, as far as reasonably practicable, the health, safety and well-being of their self.
  • If a dedicated place of work is needed at home (e.g. spare bedroom, corner of the lounge) in order to carry out professional responsibilities, this area must be treated as a place of work during working hours and a subject of a formal risk assessment.
  • The Employee must choose a safe, healthy and suitable location to perform their duty. The space should be free from any distraction, well organized and with good internet support. 
  • The Company may authorise its agent, supervisors, managers to conduct an inspection at the Remote Work Location of the Employee to check compliance with Health Norms, Safety and compliances with the Company’s policies. 
  • Any inspection must be conducted in during the normal working hours and shall be at the convenience of the Employee.

9. Equipment Management

  •  If there are any equipment is provided by the Company, it will be maintained and repaired by the Company and if there are any damages caused to such equipment due to fault/negligence of the employee, the Employee shall be solely responsible and liable to repair or replace such equipment.
  • If the equipment is availed by employee himself then such equipment will be maintained by the employee and Company accepts no responsibility for damage or repairs to Employee-owned equipment. 
  • On a case-by-case basis, COMPANY will determine, with information supplied by the employee and the Reporting Manager, the appropriate equipment needs (including hardware, software, modems, phone and data lines and other office equipment) for each Work-From-Home arrangement.
  • Equipment supplied by the organization is to be used for business purposes only. The employee must sign an inventory of all COMPANY property received and agree to take appropriate action to protect the items from damage or theft. 
  • Upon termination of employment, the employee understands that equipment and tools provided by the Company shall remain the property of the Company and will be returned to the company, unless other arrangements have been made.   
  • The Company will not be responsible for costs associated with the setup of the employee’s home office, such as remodelling, furniture or lighting, nor for repairs or modifications to the home office space.

10.  Compensation and Allowances

  • The compensation of the Employee while working from Home will be as per the terms and conditions set out in the Employment Agreement and any changes will be agreed between the Employee and the Company in writing.
  • No allowances or other expenses are applicable or will be provided under the Work from Home programme other than the equipment or tools provided by the Company.
  • Personal expenses incurred by the Employee are not eligible for the reimbursement under this Work from Home scheme. Reimbursement of any legitimate business expenses related with the Company must get approval from the Reporting Manager.

11.  Confidentiality

  • Either Party hereby agrees and undertakes to maintain utmost confidentiality with respect to Confidential Information furnished by the Disclosing Party to the Receiving Party or which comes within the knowledge or possession of the Receiving Party or its personnel, as a result of association with the Disclosing Party under this Agreement. The Receiving Party shall take necessary precautions, acceptable to the Disclosing Party to keep the Confidential Information secret and confidential. 
  • The Confidential Information shall not be used by the Receiving Party or its personnel for any purpose other than pursuant to or for the purpose of this Agreement, and, in particular, the Receiving Party shall not use the Confidential Information for its own benefit.

12.  Content & Data Protection

  • Content consists of all data, software, and information that Consumer or its authorized users provides, authorizes access, Use of the Service will not affect Company's ownership or license rights in such Content. The Company its affiliates, may access and use the Content solely for the purpose of providing and managing the Service. Company will treat all Content as confidential by not disclosing Content except to Company/Service Provider’s employees and contractors and only to the extent necessary to deliver the required Services.
  • The Employee hereby undertakes that it would not, under any circumstances, share or sell any data of the Company or its users that it may receive through any means via this Agreement to any third party.
  • Both the Parties acknowledge that they may have access to certain Data as defined under the Definitions clause. Both the parties undertake that if any data is accessed or is made available to any of their employees, agents or contractors and any other related party, they would not store, copy, imitate, record, analyse, photograph or video graph or use any other technique that may be used to manipulate this data.
  • The employee must ensure they have the proper IT systems and technology with appropriate network and communication to perform their job duties from a remote location.  
  • Consistent with the Company’s expectations of information security for employees working at the office, employees working from home will be expected to ensure the protection of proprietary information of the Company and other related entity, if any. 
  • The Company provide each employee working from home with a safety checklist that must be completed at least twice per year. Employee shall be solely responsible for the Data Security of his/her Computer system.  
  • No third parties shall present in your remote office, including family members, and should not be permitted the access to Ivy Nest’s computer or any Company related documents and the employee must ensure they are not permitted to access any other information.
  • Employee working from Home will be dealing with Company’s confidential and personal data, so reasonable steps must be taken to ensure that such data is treated with adequate regard to data protection, confidentiality and security measures. 

13. Term & Termination

  • The term of employment shall be regulated as per the Employment Agreement.

14.  Employee Consequences of Termination

  • The employee shall deliver and hand over all the tangible and intangible assets to the Company.
  • The process and consequences of termination shall be undertaken as per the employment Agreement.

15.  Employee Indemnity & Limitation of Liability

  • The Employee shall indemnify and hold harmless the Company/First Party, its promoters, officers, directors, employees, affiliates, agents, sub-contractors and other representatives from any claims, demands, liabilities, suits, proceedings, penalties, costs or expenses of any kind (including, attorneys’ fees and expenses) arising out of or in connection with (i) infringement of intellectual property rights of any Party/organisation/person by the Employee; (ii) infringement of third party intellectual property rights by the Employee or its personnel; (iii) violation of any applicable laws and statutory obligations by the Service Provider or its personnel; (iv) gross negligence and/or misconduct by the Freelancer or its personnel; (v)  breach of any obligation, terms, representation, warranties and covenants under this Agreement.
  • Neither Party shall be liable to the other for any indirect, incidental, punitive, special or consequential loss, damage, cost or expense including, without limitation, loss of profits, loss of data, and loss of revenues, of any kind whatsoever and however caused, whether arising under contract, tort (including negligence or breach of statutory duty) or otherwise, even if that Party has been advised of its possibility. 

16.  Intellectual Property & its Ownership

  • The Parties agree that all the Intellectual Property Rights created and developed by the supply of goods, services, information or other materials by Employee in connection with the performance of the Services under this Agreement and any resulting intellectual property rights are the sole and exclusive property of the Company.
